Terms and Conditions


Preamble
By registering with the Western Dredging Association ("WEDA"), you (“Registrant") accept the following terms and conditions for the use of WEDA’s online services ("terms"). These terms shall govern the contractual relationship between the Registrant and WEDA, regardless of Registrant’s WEDA Membership Status. To use the services of WEDA, the Registrant must be a legal or natural person and of age.

1. Charges
Registrant determines the amount being charged to them at the time of registration based on the choices that are made on their registration form. This online form is a binding agreement, and regardless of payment method selected, Registrant is obligated to pay the agreed price before their registration is considered active.

2.  Cancelled or Reversed Transactions
Cancellations and reversals are considered on a case-by-case basis. Please contact tmverna@westerndredging.org to find out if you are eligible.

3. Protection against Fraud and Misuse
WEDA provides the security precautions to the best of our ability to protect Registrants against fraud, identity theft and unapproved charges. WEDA cannot be held liable for any fraud or misuse, intentional or accidental, resulting from our online services.


4. Liability of WEDA and Hold Harmless
WEDA is a not-for-profit organization, and provides the best service available within the reasonable limitations of our association and industry. By accepting these terms, WEDA, its agents and associates will be held harmless and without liability for any personal loss or loss of data, regardless of circumstance.

5. Warranty of the Registrant
The Registrant pledges that all information provided to WEDA is true and accurate. In addition, the Registrant pledges that they are of age at the time of registration, provided that the Registrant is an actual person. In cases of legal entities or corporate bodies, the Registrant pledges to have the respective authority to represent the legal entity or corporate body. The Registrant may be required to confirm personal or professional credentials upon WEDA’s request.


6. Final Provisions
WEDA reserves the right to change these terms at any time, without giving reasons, but will always be within reason to the services provided to the Registrant. WEDA shall give due notice of any amendments of these terms to the Registrant.
If any provision of these terms is, for any reason, invalid and/or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. The parties agree to replace an invalid and/or unenforceable provision with a valid and/or enforceable provision which most closely approximates the intent and economic effect of the invalid and/or unenforceable provision. This also applies to contractual loopholes.

These terms and the contractual relationship shall be governed by United States Law, excluding international private law and the provisions of the United Nations Convention on Contracts for the International Sale of Goods that have been adopted by American Law.
